Intellectual Property Policy for Sellers

Your listings on the seller portal must comply with all federal, state, and local laws and our policies applicable to your products and product listings. 

Sellers should not violate the IP rights of brands or other rights of the owners.

If IP rights, laws, and policies of BonziCart are violated, it results in the termination of selling privileges, and you may face other legal consequences.

Intellectual property rights are of three main types

  1. Copyrights - An exclusive and conveyable legal right provided to the originator to print, publish, perform, film, or record literary, artistic, or musical material for a fixed number of years.
  2. Trademarks - Trademark is a symbol, word, or words legally registered or established by use as representing a company or product.
  3. Patents - Patents may be a government authority or license conferring a right or title for a collection amount, notably the only right to exclude others from creating, using, or merchandising an invention.

Infringement Cases

For a product not sold on the BonziCart website, you can always reply to us and provide the required details to prove the non-selling of the reported product. We will further investigate the dispute and rectify if the error occurred.
For the license or other agreement that allows you to use the Intellectual property identified in the accusation, you should contact the owner of the rights who raised a complaint. In such disputes, you may have to remove your content/listing upon proving guilty.


If an accusation of trademark or counterfeit infringement of the product or package comes on your listing, you should provide details of the invoice and product id to demonstrate the authenticity of the product. Upon submission of the details, we reevaluate the notice, and your content will be reinstated if it is not violating IPR.


In the case of trademark or counterfeit infringement of the product on the product detail page, we recommend modification in the product detail page or pages to make sure they do not infringe the trademark. After rectification you can write to us, We investigate your product page in detail, and upon finding the correction to be satisfactory, your content will be reinstated.


In case of patent infringement reply to the notice you received, stating the reasons behind infringement. You can also provide court order copies saying the non-infringement or the patent proving to be invalid.


In case of copyright infringement, you should send counter-notice along with details and self-attested copies of the details of the product being removed from our website.

 IP enforcement:

If you receive an infringement notice or warning for your listing which you feel is far from the truth. You can always write to us regarding the same and rectify the mistake.

If you receive multiple notices or warning on the products which are not being sold by you, you can submit an appeal to us in writing form with copies of notice attached. 
If you receive an infringement notice for selling non-infringing products, write to us with details of the invoice to prove authenticity of the product or authorization copy of the owner or court order that shows that your product does not infringe the asserted IP.
Your seller account will be under the suspension if you get multiple infringement notices.
If your account gets suspended due to IP infringement notices against your product or content; You can write to us about your action plans. BonziCart evaluates your action plans, and your account will be reinstated if your action plans found satisfactory.
BonziCart takes infringement notices and claims seriously. We take serious action against whom infringement claims prove true. In any case, the infringing authority will be penalized, and their account will be suspended without a second thought. We recommend sellers to consult legal advice to deal with infringement notices, and we always expect you to follow the right procedures to avoid IP infringements.
